General Conditions of Sale
The client certifies that they have full legal powers and capacity to commit to the following terms and conditions. Acknowledgment and acceptance of the general sales terms and conditions is mandatory when making a reservation (and must be confirmed upon making said reservation). It is not possible to make a reservation without agreeing in full to the terms and conditions set forth hereafter. The clients remain solely responsible for the choice of the services and their relevance to their individual needs. Miramar La Cigale will bear no responsibility in this respect.
Reservations and payment
Hotel stays only
Types of reservation:
Concerning hotel stays, Miramar La Cigale proposes two types of reservations: flexible and prepaid. The “Flexible” rate (daily rate) lets you cancel your stay at the hotel up to 24 hours in advance with no penalty (until 3 pm the day before your arrival). “Prepaid” reservations, also called “non cancellable – non refundable”, include a 5% discount on the flexible rate and reservations may not be cancelled once your payment has been made. Concerning reservations via the internet, the 5% discount is already included for the “flexible” rate. As a result, the flexible rate mentioned includes the discount and the “prepaid” rate allows you to benefit from a 5% discount on the “flexible” rate. Prices differ for reservations made over the telephone (or walk in) and via the internet.
Reservations made directly via the Reservation Platform
Reservations must be confirmed with the hotel in writing, by fax: +33 (0)184.108.40.206.37 or e-mail: firstname.lastname@example.org. They will only be taken into account after payment by cheque, cash or credit/debit card, of the amount due, according to the type of reservation. We do not accept checks from foreign banks :
–“Flexible” reservations: the amount to be paid corresponds to 30% of the total amount due for your stay.
– “Prepaid” reservations: the amount to be paid corresponds to 100% of the total amount due for your stay
A credit card number is required upon making your reservation in order to guarantee the latter. If no payment is made, the credit card will be debited following the same terms as for cancellations.
For stays of one week or more, the services will be paid per periods of 7 days.
For reservations of short stays or thalassotherapy treatment sessions, 30% of the total amount for your stay will be required upon making your reservation. All payments made using a bank card will be debited immediately. For reservations made less than 15 days before your stay, the deposit will be paid by credit card only. In the case of payment by cheque, this latter must be received within 7 days maximum in order to secure your reservation. After this period the reservation will be automatically cancelled without notification. The total amount due for your hotel stay will be due upon your departure from the establishment. For Thalasso treatments of one week or longer, treatments and services will be invoiced and paid per periods of 7 days.
By booking your stay with thalassotherapy-spa treatments (cures and short stays with accommodation only) on our website: https://www.miramar-lacigale.com/en/ – payment under the usual conditions presented in these terms of sale which is 30% deposit – you get an exclusive discount of -10% on the price of the selected stay. This 10% discount is already applied in the final price. This “-10% web” rate is only available on our website with an online payment. This reduction “-10% web” applies throughout the year from its implementation: 27/03/2018. Future promotions or promotional discounts will be applied directly on the -10% web rate.
The rooms are available from 3 pm on the day of your arrival and must be vacated by 12 noon the day of your departure.
You may ask for late departure at 6 pm subject to availability. This will be invoiced an extra €100. It is also possible to settle into your room before 12 noon under the same conditions, i.e. for an extra €100.
Your stay includes free access to the hotel’s sports facilities during the opening hours (hammam, gym room, panoramic heated seawater swimming pool, oceanic spa). You may enjoy these facilities for the entire period of your stay, from 12 noon on the day of your arrival to 3 pm on the day of your departure.
Any damage caused by the client to their room will be invoiced. The hotel will not be responsible for any theft, loss or damage incurred by luggage that is left in the common areas of the establishment or in a room that has not been locked.
Conditions applying to children
The Oceanic Spa and the Parcours Marin are reserved for guests aged 14 years and older accompanied by an adult. Hammam for guest aged 16 years and older. Accommodation is free for children under 12 years old staying in the same room as their parents – treatments (massages, etc) must be paid – (except for Passerelle and Escale categories), limited to 1 child per room (Categories: Au Fil de l’Eau, Terre & Mer, Grand Large) and 2 children per room (Categories: Suite Fil de l’eau, Junior Suite Grand Large, Suite Grand Large, Suite Prestige Fil de l’Eau & Suite Prestige Grand Large). Breakfast is free for children up to 12 years old.
All prices are in Euro inclusive of VAT. They do not include beverages, restaurant, telephone, and personal expenses, medical fees, tourist tax.
Concerning our Package deals, no refunds may be made for services that have not been used. Please contact the Reception desk to make changes such as half-board to full board during your stay.
The listed prices may be modified without notice and are valid for 48 hours. Beyond said period the prices may be subject to change.
Gift vouchers may not be exchanged or refunded. They are valid for a period of one year from the date they are issued on, excluding during the annual closing period (typically in January).
Any course of treatment and/or care sessions interrupted by you, as well as any services you may have reserved and failed to use, regardless of the reason, will not give the right to any refund.
Concerning the reservation of treatments, rituals and day packages, and external treatments, full payment is required upon making your reservation.
Prices may change in the case of adjustments made to the VAT rate in France and/or other taxes applicable to the industry. Clients will be notified via email of any such changes affecting the prices.
Said notification does not bind us to automatically change our prices should the VAT rate change. In such case, given that the establishment will be subject to new legal requirements that have an impact on the sales prices of its services, this will be passed on and integrated into the new prices. The thalasso prices are displayed on the website and the booking engine in half-double price (price per person for a double room – 2 spa users).
15€ gift voucher – For a booking on miramar-lacigale.com only
Valid for all reservations that include accommodation (with or without Thalasso treatments; based on date of purchase only and not on the date of arrival), from February 13th 2018: Make your reservations through the website www.miramar-lacigale.com and enjoy a gift voucher worth €15 (1 voucher per reservation completed, non-transferable, valid only during the current stay, it is not usable during a next stay) valid at Miramar La Cigale, during your stay with accommodation only. The voucher can be used to pay for purchases at the Thalassotherapy centre, at the bar and restaurants (it cannot be deducted from the outstanding invoice at the end of your stay). When using the vouchers, please inform the staff that you will be using a gift voucher to pay for the services or purchases (you will be asked to present the gift voucher in order to benefit from the offer). Please note that, should you opt to purchase products or services for an amount lower than the amount mentioned on your gift voucher, the difference will not be refunded. It is not possible to use the gift voucher in several instalments. The use of the gift voucher to pay for mini bar consumptions is allowed. The gift voucher will be handed to you upon your arrival at the hotel reception desk. Reservations made via internet that do not include accommodation (treatments and care à la carte, Thalasso Days & Rituals, non-resident treatments and gift coupons) are not eligible to the gift vouchers and will not benefit from the €15 voucher offer. A credit card is requested before entering a room, suite or apartment. A PREAUTHORIZATION is carried out at the check-in.
Cancellations – No show
Hotel: Flexible reservation – you may cancel your stay at the hotel up to 24 h in advance with no penalty (3 pm on the day before your arrival). Prepaid reservations – “non-cancellable, non-refundable” – include a 5% discount on the flexible rate. However it is not possible to cancel your reservation once your payment has been made.
Thalasso: the date of cancelling will be taken into account to determine the cancellation fees. You can cancel your stay with no penalties applied up until 15 days in advance. After this the full amount of your deposit will be retained by the establishment as compensation.
All requests concerning cancellations must be made in writing (post, fax, email) and sent to our Reservations Department (email@example.com). This will entail a processing fee of €50 per person concerned by the cancellation.
The cancellation fees will be determined based on the date on which the cancellation is notified. Any deposit paid will be refunded for cancellations made more than 15 days before the arrival date. The abovementioned processing fees will be deducted from the amount due.
It is also possible to postpone your stay for up to 6 months after the initially planned arrival date. In such case, the hotel will retain the deposit paid and will change your reservation according to your new dates. The price of the stay will be adjusted depending on availability and prices for the period at the new dates.
Stays associated with thalassotherapy sessions
If your reservation for a stay with Thalasso sessions is cancelled less than 15 days before the date of arrival or in the case of no show, the hotel will retain the full amount of the deposit paid, that is to say 30% of the total amount due for the stay.
Thalassotherapy reservations for non-resident guests
If your reservation is cancelled less than 15 days before the date of arrival or in the case of no show, the hotel will retain the full amount already paid for the services.
It is also possible to postpone your stay for up to 6 months after the initially planned arrival date. In such case, the hotel will retain the deposit paid and will change your reservation according to your new dates. The price for the thalassotherapy sessions will be adjusted depending on availability and prices for the period at the new dates
Right of withdrawal
With respect to article L. 221-28 of the French Consumer Law, it is reminded here that clients do not benefit from the dispositions stipulated in article L. 221-18 pursuant to the withdrawal of their orders and reservations. The sales terms and conditions that apply to the tariffs are mentioned on the products’ information sheets of said tariffs or are given orally for reservations made by telephone. Prepaid reservations may not be modified and/or refunded. The full amount paid for the deposit will be retained by Miramar La Cigale.
In cases where modifications to the prices and/or cancellation are possible, please contact our Reservations Department to exercise your rights (+33(0)2 97 53 49 13).
At the conclusion of the contract between the client and Miramar La Cigale, the hotel collects personal information used for management purposes and for telephone soliciting. The Customer has the opportunity to oppose its future usage (excluding current commercial relationship) by registering today on the list opposition to canvassing telephone blocktel (https: //www.bloctel.gouv.fr /). This is a right for the consumer and the customer can from the reservation, specify that he does not wish to be solicited by phone or email in the future.
Promotions and special offers
The website www.miramar-lacigale.com features different special offers that are accessible via the menu or home page. These promotional deals are subject to conditions and to the discretion of the establishment. The hotel reserves the right to terminate or extend said offers at any time. Promotional, exclusive and/or special offers are non-cancellable, non-modifiable and non-refundable, and are conditional to the payment of a deposit that may vary depending on the type of offer concerned. All our offers are subject to availability. The prices mentioned are per person (price per person for two guests sharing a room).
The “Ambassador Program” is open to all guests of Miramar La Cigale who have spent at least 3 stays with a thalassotherapy treatment program of 4 days and 4 nights minimum.
To participate, become Ambassador of Miramar La Cigale and share your experience at Miramar La Cigale to your friends and invite them to book a stay with thalassotherapy treatment program at Miramar La Cigale 4 days and 4 nights minimum so they can enjoy a VIP welcome in your room during their first stay.
This “Ambassador Program” will give you a valid advantage on your next thalassotherapy stay of 4 days and 4 nights minimum:
– Following the booking of one referral, the Ambassador will receive a discount of 10% on his next stay, applicable on the best offer of the moment.
– Following the booking of two referrals, the Ambassador will receive a discount of 10% on his next stay, applicable on the best offer of the moment and a gift voucher of € 100 to be used for services reserved for Miramar La Cigale (additional treatments à la carte in thalassotherapy or aesthetics, catering and bar).
– Following the booking of three referrals and more, the Ambassador will receive a 10% discount on his next stay, applicable on the best offer of the moment and a gift voucher of € 150 to use for services reserved for Miramar La Cigale (additional treatments à la carte in thalassotherapy or aesthetics, catering and bar).
For the sponsorship to be valid, the reservation of the godson and the Ambassador must be done on our website (by specifying in the comment section in step 3 the name and surname of the ambassador), directly from the reservation center at Miramar La Cigale, by phone at 02.97.53.49.13 or by email at firstname.lastname@example.org.
To benefit from these advantages, the godchild will have to specify to the customer service representatives, when booking (directly or on the website), the first name and the name of his Ambassador who has given him prior authorization to communicate them.
The Ambassador will enjoy his benefits after the departure of his or her godchildren.
This sponsorship operation begins on July 15, 2018 and will remain active until the Miramar La Cigale decides to stop it.
The Miramar La Cigale reserves the right to change at any time the maximum number of people sponsored.
Health check-up or medical certificate
You can choose to meet one of our doctors as part of the health check-up before starting a Thalasso course (non-mandatory, invoiced €36* per person) or you can send us a medical certificate prepared by your personal doctor attesting to the fact that there are no contraindications for you regarding the practice of sports activities and/or thalassotherapy sessions.
Medical and physiotherapy acts performed as part of a Thalassotherapy course are not refunded by the French social security – Caisse Nationale d’Assurance Maladie – circular 5698 dated 23 Dec. 1998.
Cats and dogs are welcome to stay the hotel (for an extra €20/day, please check with our Reservations Department) provided they are kept on a leash when on the hotel premises. Please note that they are NOT allowed on the 4th floor of the establishment where are situated the restaurants, bar, swimming pool and gym room, access is also forbidden for pets to all the thalassotherapy facilities.
Non-smoking & Non-electronic cigarette establishment
Please note that the establishment is entirely NON-SMOKING (rooms and lobby included), e-cigarette included.
Protection of personal data
Reservations are processed in electronic format. Consequently, in compliance with French decree “informatique et liberté” dated January 6th 1978, you have the right to access, modify and delete any information pertaining to your person.
Referrals – invitations
The Client agrees to refrain from inviting guests whose behaviour could be detrimental in any way to the establishment, the latter reserves the right to take all necessary measures to remedy such behaviour where necessary.
Any dispute and complaint can only be taken into account if they are formulated in written form to Miramar (Miramar La Cigale – Port du Crouesty CS 60003 56640 ARZON or email at email@example.com). In the case of claims and/or disputes, and following failure to settle the issue out of court, the case will be brought before territorially competent courts under the Code of Civil Procedure, or the jurisdiction of the place where he remained at the time of the conclusion of the contract or the occurrence of the fact damaging.
In the event of any dispute between the Client and the Miramar La Cigale Hotel Thalasso & Spa resulting from these general conditions of sale, the Customer is informed that he has the possibility to use a mediator (Jean-Pierre Teyssier, MTV Mediation Tourism Travel, BP 80 303 – 75 823 Paris Cedex 17 or on https://www.mtv.travel/) which will attempt, in all independence and impartiality, to bring the parties together with a view to reaching an amicable solution. The parties are free to accept or refuse the use of mediation.
The establishment reserves the right not to fulfil its obligations or to postpone the execution of the latter in the case of exceptional events, or in the case of a force majeure event (complete or partial destruction of the establishment, industrial action, fire…).
